Fees, Payments, Refunds & Client Funds Policy

Article I – Scope & Legal Effect

This Policy applies without exception to:

      • All clients engaging SJP Consultancy (“SJP”)
      • All employees, contractors, consultants, agents, and representatives of SJP

This Policy:

      • Forms a legally binding part of all service agreements (written, verbal, or electronic)
      • Applies to all jurisdictions, currencies, and payment methods
      • Governs all financial interactions between SJP and its clients

By making any payment to SJP, the client irrevocably agrees to this Policy in full.


Article II – Professional Fees

2.1 Advance Payment Requirement

    • All professional fees are payable in full, in advance
    • Work will not commence until funds are:
      • Received
      • Cleared
      • Irrevocably credited to SJP

2.2 Nature of Fees

All fees paid to SJP are:

      • Payment for professional time, expertise, advisory services, case preparation, and representation
      • Earned upon receipt
      • Not contingent on outcome, approval, or success

2.3 Fee Determination

Fees are determined based on:

      • Complexity and risk of the matter
      • Jurisdiction and regulatory environment
      • Time, resources, and specialist expertise required

All fees are confirmed in writing prior to engagement.

2.4 Exclusions

SJP fees do not include:

      • Government or immigration fees
      • Embassy or consular charges
      • Legal or court fees
      • Translation, notarisation, or certification costs
      • Courier or administrative expenses
      • Third-party service provider costs

These remain the sole responsibility of the client.


Article III – Payment Methods & Compliance

3.1 Accepted Payment Methods

SJP accepts payments including, but not limited to:

      • Bank transfers (domestic and international)
      • Online payment platforms (e.g., Wise, PayPal, Stripe, etc.)
      • Debit and credit cards
      • Cash payments (where permitted by law)
      • Third-party remittance services

3.2 Client Responsibility

Clients agree that:

      • They are the authorised account holder or have full legal authority to use the payment method
      • All payments are made lawfully and in compliance with applicable financial regulations
      • Any associated fees, exchange rates, or transfer costs are borne by the client

3.3 Cleared Funds Requirement

SJP will only recognise payment once funds are:

      • Fully cleared
      • Not subject to reversal
      • Freely available for use

Article IV – Strict No Refund Policy

4.1 Non-Refundable Fees

All fees paid to SJP are strictly non-refundable under any circumstances, including but not limited to:

      • Visa or application refusal
      • Government or third-party decisions
      • Delays or processing times
      • Changes in law, policy, or regulation
      • Client withdrawal, cancellation, or change of mind
      • Personal or financial circumstances

4.2 No “Cooling-Off” Period

To the fullest extent permitted by law:

      • No statutory or discretionary cooling-off period applies
      • Clients expressly waive any right to claim otherwise

4.3 Limited Discretion

Any refund (full or partial):

      • Is entirely at the sole discretion of the Managing Partner
      • Shall be exceptional and not precedent-setting
      • Constitutes full and final settlement of all claims

Article V – Chargebacks, Payment Disputes & Recovery

5.1 Prohibition on Chargebacks

Clients expressly agree:

      • Not to initiate chargebacks, reversals, or disputes through banks or third-party providers
      • That doing so constitutes a material breach of contract

5.2 Liability for Costs

Where a chargeback or dispute is initiated, the client shall be fully liable for:

      • The original fee
      • All administrative and processing fees
      • Banking and third-party penalties
      • Currency exchange losses
      • Legal fees and recovery costs
      • Debt collection agency fees

5.3 Recovery Action

SJP reserves the right to:

      • Pursue legal recovery proceedings
      • Engage debt collection agencies internationally
      • Report fraudulent disputes to financial institutions

All recovery costs will be charged to the client on a full indemnity basis.


Article VI – Client Funds Handling

6.1 Role of SJP

Where SJP holds funds for third-party payments:

      • SJP acts solely as a facilitator
      • SJP assumes no liability for third-party actions or outcomes

6.2 Disbursement Conditions

Funds will only be released:

      • For legitimate, documented purposes
      • In accordance with client instructions or case requirements

6.3 Compliance & Record Keeping

      • All transactions are recorded for audit and compliance purposes
      • SJP maintains appropriate internal financial controls

Article VII – Client Responsibilities

Clients agree to:

      • Provide accurate, complete, and truthful information
      • Disclose all relevant facts
      • Comply with all laws and authority requirements
      • Respond promptly to requests

Failure to comply may result in:

      • Delays or refusal of applications
      • Termination of services
      • Additional fees

SJP bears no liability for consequences arising from client failures.


Article VIII – Limitation of Liability

8.1 No Guarantee of Outcome

SJP provides professional assistance only and:

      • Does not guarantee approvals, outcomes, or timelines
      • Has no control over government or third-party decisions

8.2 Exclusion of Liability

To the fullest extent permitted by law, SJP shall not be liable for:

      • Direct or indirect losses
      • Financial or economic loss
      • Reputational damage
      • Business interruption
      • Consequential or incidental damages

8.3 Maximum Liability Cap

Where liability cannot be excluded by law:

      • SJP’s total liability shall not exceed the fees paid by the client

Article IX – Professional Standards

All SJP personnel must maintain:

      • Confidentiality
      • Integrity
      • Legal compliance
      • Professional competence

Client information is protected except where disclosure is required by law.


Article X – Amendments

SJP reserves the right to:

      • Amend this Policy at any time
      • Publish updates via official channels

Continued engagement constitutes acceptance of any revised terms.


Article XI – Governing Law & Jurisdiction

This Policy is governed exclusively by the laws of England & Wales.

All disputes shall be subject to the exclusive jurisdiction of the courts of England & Wales, regardless of:

      • Client location
      • Payment method
      • Service location

Final Legal Acknowledgment

By making payment to SJP Consultancy, the client:

      • Confirms they have read, understood, and accepted this Policy
      • Acknowledges that fees are for professional services rendered, not outcomes
      • Accepts that all payments are final, non-refundable, and legally binding
      • Agrees to be bound by all terms, including chargeback liability and recovery enforcement
